In obedience to an Order of Sale of the Chancery Court of Cumberland County, in Crossville, Tennessee, made in the case of THE CONSERVATORSHIP OF BOBBIE RUTH WILSON, and being Cause No. 09-CH-234, I will on SATURDAY, the 21st day of NOVEMBER, 2009, at the hour of TEN OCLOCK, A.M., (Central Time), on the premises located at 72 Gore Road in Crossville, sell to the highest and best bidder, the tract of land in said Order described, located in the FIRST CIVIL DISTRICT of Cumberland County, Tennessee, more fully described as follows:
Being lots number 4 and 5 of the Albert Gore Subdivision, with street address of 72 Gore Road. Identified as Map No. 113-P, Group A, and Parcel No. 17.00 in the Cumberland County Tax Assessor's Office. For further reference, see Deed Book 174, Page 46 in the Cumberland County Register of Deeds Office.
Said sale will be for 20% cash in hand at the close of the bidding, with balance evidenced by Promissory Note, due and payable ten (10) days from date of the confirmation of sale. Said sale will be made in bar of the equity of redemption and subject to real property taxes for the tax year of 2010.

Whereas, by Deed of Trust dated December 26, 2006, and recorded at Book 1253, Page 32, in the Register's Office for Cumberland County, Tennessee, Dennis G. Hargis and Susan L. Hargis, conveyed the hereinafter described property to secure the payment of all debts of Dennis G. Hargis owing to Regions Bank and assigned to First Bank by Assignment dated February 23, 2007, and recorded at Book 1265, Page 2143, in the Register's Office for Cumberland County, Tennessee. On October 13, 2009, Walter N. Winchester, of Knoxville, Tennessee, was appointed as Successor Trustee by the Beneficiary, FirstBank. Default has been made in the payment of said indebtedness, the entire balance has been declared due and payable in full and the owner and holder of said Note has directed me to foreclose said Deed of Trust.

Beginning at a found 5/8 rerod on the southerly right-of-way line of Gordon Road 20 ft. wd. Being the same property conveyed to Dennis G. Hargis and wife, Susan L. Hargis, by deed of record, from Eugene L. Flury, Jr. and wife, Bonnie S. Flury, dated 04/02/98, and recorded 04/03/98, in the Registers Office of Cumberland County, State of Tennessee, in Deed Book 1014, Page 206.
Said real estate has a street address of 509 Gordon Road, Crossville, Cumberland County, Tennessee 38572. In the event of a discrepancy between the street address and the property description, the property description shall control.
The Real Estate will be sold AS IS WHERE IS with no warranties or representations of any kind, express or implied, and including warranty for a particular purpose. The Successor Trustee may sell the above described Real Property together as a whole or in lots, parcels, or tracts, as announced at the sale, and no such successive sales shall exhaust the power of sale. The aforesaid sale may be postponed to a later date by oral announcement at the time and place of the published sale or cancelled without further written notice or publication. The Successor Trustee reserves the right to take or accept the next highest, or best bid, at such sale should the last and highest bidder fail or refuse to comply with the terms of sale for any reason. In such event, the Successor Trustee shall also reserve the right to reopen the bidding or republish and sell said Real Estate at the option of the undersigned. The Beneficiary may bid on said Real Estate and the Successor Trustee reserves the right to conduct the sale by or through his agents or attorneys acting in his place or stead, including the use of an auctioneer.
